Crystal McKinney, a former model, has filed a lawsuit against film producer Harvey Weinstein, accusing him of luring her and a friend to his hotel room in 2003 and then sexually assaulting them.
The lawsuit was filed in New York’s Manhattan Federal Court on Friday, according to documents obtained by People.
McKinney claims that Weinstein, 73, who is currently in jail awaiting a re-trial for his sex crime convictions, set up a meeting with her to discuss “business opportunities” in the film industry.
She alleges that after an initial meeting at a nightclub, Weinstein invited her and her unnamed friend back to his room at the Ritz-Carlton Battery Park Hotel in New York City for a private conversation.
According to the lawsuit, McKinney claimed Weinstein “piled” alcohol on them before touching her chest.
She further alleged that when she and her friend went to the restroom, Weinstein entered with his genitals exposed.
McKinney claimed Weinstein then forced her and her friend to engage in sexual acts with each other before he allegedly raped them.
Weinstein was convicted in New York State for rape and sexual assault in 2020 and sentenced to 23 years in prison.
However, his convictions were overturned in April 2024 by the New York Court of Appeals, which ruled he did not receive a fair trial because women whose allegations were not part of the charges were allowed to testify.
Despite the overturned conviction in New York, Weinstein remains incarcerated due to his 2022 convictions for sex crimes in California, where he is serving a 16-year sentence.
He has been transferred to Bellevue Hospital in New York for his current retrial, which began jury selection in April 2025.
Weinstein had previously asked a New York judge to speed up his retrial, citing poor health and claiming he didn’t know “how much longer” he could “hold on” while at Rikers Island.
This lawsuit against Weinstein comes as Crystal McKinney is also an accuser in the ongoing federal sex trafficking trial against Sean “Diddy” Combs, who has pleaded not guilty to his charges.
