In the wake of a serious infant health crisis, major retailers have come under fire for failing to promptly remove a recalled baby formula from their shelves. The recalled product in question, ByHeart Whole Nutrition Infant Formula, was associated with a widespread outbreak of infant botulism, affecting at least 51 infants across 19 states. Symptoms of infant botulism include constipation, poor feeding, and difficulty breathing, with effects sometimes appearing weeks after exposure. ByHeart Inc. initiated a voluntary recall on Nov. 8, which was later expanded on Nov. 11 to cover all unexpired lots.
Despite the recall announcements, FDA investigators discovered that the recalled formula was still available for purchase in various states at Walmart, Target, Kroger, and Albertsons stores. In some instances, the recalled formula was even being promoted with discounts and sale signs after the recall expansion. The FDA emphasized that the sale of recalled infant formula is a violation of federal law, regardless of whether contamination is confirmed.
In response to the FDA’s findings, retailers were sent warning letters and reminded of their legal obligation to promptly remove recalled products from their shelves. While some retailers reported taking corrective measures such as blocking sales and removing products from their stores and online platforms, documentation showing consistent nationwide action was not provided at the time of the warning letters.
The FDA stressed the importance of swift and thorough removal of recalled products to prevent further infant illnesses and maintain public trust in the safety of infant nutrition products. Retailers have been given 15 working days to respond to the warning letters with specific steps to correct violations or explanations for why they believe they are not in violation.
